New FDA Proposal Would Ensure Cosmetics Are Asbestos-Free

New FDA Proposal Would Ensure Cosmetics Are Asbestos-Free

When you hear the word “asbestos,” you might think of problems with insulation or popcorn ceilings from the 1950s. Medical researchers have classified asbestos as a carcinogen, which makes any exposure to asbestos a health risk. The dangers associated with asbestos have been designated as a carcinogen that can lead to serious health problems.

As a result of this medical research, asbestos has been banned in a wide variety of building materials and products. Now, Congress has put forth a new federal rule that mandates that the Food and Drug Administration (FDA) compel cosmetic companies to take extra steps to ensure that any of their talc-based products are free of asbestos. That includes makeup, baby powder, and other personal care products.

These mandates follow major lawsuits filed against Johnson & Johnson and other personal care companies. The lawsuits allege links between talc-based baby powder and cancer. How does asbestos get into baby powder?

Cross Contamination

As explained by the FDA, talc is a mineral that absorbs moisture and improves the texture of cosmetics. It is mined from underground deposits that are often near deposits of asbestos, which increases the risk of cross-contamination on a molecular level.

Those risks were enough to prompt Congress to take action. This set up the 2023 law requiring the FDA to release new industry standards that companies must comply with.

In a recent story for the AP, Dr. Linda Katz, the director of the FDA’s Office of Cosmetics and Colors, said in a statement that the agency has “carefully considered the scientific evidence and complex policy issues related to detecting and identifying asbestos in talc and talc-containing cosmetic products. We believe that the proposed testing techniques are appropriate methods to detect asbestos to help ensure the safety of talc-containing cosmetic products.”

Obtaining Legal Help for a Product Liability Claim

Determining the link between asbestos in cosmetics and self-care products can be a challenge. These types of claims are considered product liability. Johnson & Johnson is already offering a settlement of $8 billion to settle several thousand lawsuits. That is a good indication of liability that can be used to support your claim.

If there has been a cancer diagnosis in your family with a history of using talc products, you should discuss the matter with Frost Law Firm, PC. We have a long history of asbestos injury claims. We understand the complexity of these claims and provide the guidance you need to make an informed decision about the best course of action. Call to discuss what is going on.
